Generals terms and conditions
1. Introduction and scope
Yoojo is a networking platform dedicated to home services, which enables users to publish advertisements requesting services (called "Jobs") and service providers to offer their services. These Terms and Conditions of Use apply to all registered users, whether clients or service providers, and govern the use of the Yoojo platform.
Yoojo is a trademark of Netdistrict, a limited company registered with the Registry of Geneva (Switzerland) and whose registered office is Chemin de Pré Fleuri 5, 1228 Plan-Les-Ouates.
2. Definitions, Roles, Responsibilities and Limitations
2.1 Definitions
Yoojo or Platform: the set of features and services provided by the website whose URL is yoojo.fr, as well as the mobile applications available on the Apple and Android stores.
Client: a natural person or legal entity registered on the Site, acting in their own name and on their own behalf, who is looking for a private individual or a self-employed contractor to perform a service and who publishes one or more job listings on the Site for this purpose.
Providerr: a natural person or self-employed contractor registered on the Site, acting in their own name and on their own behalf, who is seeking to be contacted by a Client in order to carry out service tasks.
Service: refers to the service offering published by Yoojo on its Site or on a Partner’s site for the purpose of intermediation through the platform.
Member: a Client or Provider with an active account on the platform.
Wallet: an electronic money account similar to a bank account, opened with Mangopay on behalf of the Member. The account is used to hold funds in escrow pending completion of a service.
Yoojo+: a monthly subscription plan offered by Yoojo allowing Clients to benefit from certain advantages when booking services on the Platform, under the conditions defined in section 4.3.
2.2 Role of Yoojo
Yoojo is an intermediation platform that facilitates contact between customers and service providers. The platform enables customers to publish service advertisements and service providers to offer their services. Yoojo plays no role in the provision of the service or in the contract between the customer and the service provider, who remain solely responsible for their commitments.
2.3 Roles not assumed by Yoojo
Yoojo does not play any role other than that of a medium for Internet advertisements and for putting the parties in contact with each other, and therefore:
is neither a recruiter, nor an employer, nor a temporary employment agency or company;
has no subordinate relationship with Customers or Service Providers;
is under no circumstances authorised by the Service Providers to seek out third parties requesting the provision of services;
is in no way a party to any contract that may exist between a Customer and a Service Provider;
is at no time involved in the provision of services between Customers and Providers, which are beyond the Site's scope of competence and intervention.
2.4 Customer liability
2.4.1
Customers are responsible for providing accurate information and a detailed description of the services required in their adverts. They undertake to pay the service provider for the service provided in accordance with the agreed terms and conditions.
2.4.2
Customers acknowledge that they alone are responsible for all the content they include on the Site (text, photographs, images, logos or other content).
2.4.3
Customers are responsible for making all necessary declarations to government bodies in accordance with the terms of the relationship established with the Service Provider.
2.4.4
Depending on the data provided by the customer, Yoojo may propose a number of hours to carry out the service. This recommended duration is purely indicative. The Client alone is capable of defining the duration for which it wishes to contract the Service Provider.
2.5 Responsibilities of Service Providers
2.5.1
The Providers must prove that they can regularly work in the Country where they offer their services.
2.5.2
The Service Providers are responsible for the quality and performance of the service offered. They are also responsible for meeting their commitments to customers.
2.6 Limitations
2.6.1 Ineligible services
Yoojo is a home services platform. The list of services available on the Platform may change at any time depending on local regulations and the ability of members to offer the service.
However, without this list being exhaustive, the following activities are not authorised on the platform:
Any building construction/renovation activity covered by compulsory insurance that affects the soundness of the structure and/or renders it unfit for its intended use.
Activities and assignments subject to compulsory insurance or regulated professions.
Activities in the financial, political, pharmaceutical, medical, industrial engineering or construction, mechanical, aeronautical, space, nuclear and arms sectors.
Financial consultancy and audit, financial communication consultancy, asset management consultancy, investment consultancy and financial engineering in general.
2.6.2 Provider skills
Yoojo allows Service Providers to present their skills and equipment. Yoojo does not validate this data. The Service Providers are solely responsible for proposing services that they are capable of performing, in accordance with the pricing conditions defined at the time of booking.
The Platform is a community space and it publishes the quality data of the services provided on the Platform, on the basis of information provided by Customers. This information is provided for information purposes only and cannot be verified by Yoojo.
Yoojo is not responsible for the proper implementation of the Service, but will do its utmost to assist members in this regard and within the limits of its field of competence.
3. Member registration
3.1 Eligibility
Registration on the Site is open only to natural persons who have reached the age of majority under the legislation in force in the country where the service is provided and who enjoy full legal capacity. Yoojo reserves the right to refuse registration to any individual who does not comply with these Terms and Conditions or with current legislation.
3.2 How to register
To publish a job advert or a Supplier Profile, all Internet users must register on the Site to become a Member. To do this, they can:
go to the Site, click on the "Register" tab and fill in the mandatory fields on the Site's registration form (user name, password, postcode, valid e-mail address, etc.). Once these fields have been completed, the Internet user must validate the registration form by clicking on the "Register" button and accept the Site's General Terms and Conditions.
register via the Facebook™ Connect website ["Facebook" is a trademark of Facebook Inc, a company established and registered in the State of Delaware, registration number: 3835815, Secretary of State, State of Delaware], the use of which implies compliance, in particular, with the "Declaration of Rights and Responsibilities", the "Facebook Platform Rules" and the "Data Use Policy - Other websites or applications" of the Facebook company. Connection to the Site by this means, which also implies acceptance of these General Terms and Conditions, does not mean that the Site is affiliated with, sponsored or approved by Facebook.
3.3 Validity
By validating their registration, Internet users acknowledge that they have filled in the registration form truthfully and as accurately as possible, using current personal data. If any of the required information changes over time, the Member undertakes to amend it in his or her profile as soon as possible.
4. Services and financial conditions for Customers
4.1 Rates for services offered by Providers
The Service Providers are free to set their hourly rates for each service. They may change their rates at any time, provided they are above the minimum hourly rate defined by law.
The application provides Providers with statistical data on prices charged by category. This data is purely for information purposes and is not mandatory.
4.2 Platform Service Fees
Publishing a job listing on the Platform is free of charge; however, service fees apply when booking a Service Provider.
The billing type, pricing, and duration are defined within each offer and summarised before the end of the checkout process. The service subscription contract becomes binding upon clicking the relevant confirmation button at the time of placing the order.
The service fee amounts to 20% of the Service Provider's remuneration, with a minimum charge of £5.00 (inclusive of VAT).
For childcare or pet-sitting services, payment of the Service Provider's remuneration through the Platform is not mandatory; in such cases, a flat-rate connection fee will apply instead:
Childcare: flat-rate service fee of £9.00 (inclusive of VAT)
Pet-sitting: flat-rate service fee of £12.00 (inclusive of VAT)
Customers who have subscribed to the Yoojo+ plan may benefit from specific booking conditions with no service fees and no upfront payment, subject to the limits and conditions set out in section 4.3.
Service fees entitle the Customer to the following:
Access to secure payment solutions for bookings
Access to tools for managing the relationship with the Service Provider
Access to customer support during opening hours
Basic Yoojo Cover protection as defined in the dedicated section
4.3 Yoojo+
Pricing and Duration: The Yoojo+ subscription is available under two plans:
Monthly subscription at £9.90 per month (inclusive of VAT)
Annual subscription at £94.80 per year (inclusive of VAT)
The subscription is rolling with no minimum commitment. The Customer may cancel at any time; cancellation takes effect at the end of the current billing period (monthly or annual, depending on the chosen plan).
The subscription may be upgraded at any time from a monthly to an annual plan. In such cases, the annual fee will be adjusted on a pro-rata basis to account for any unused portion of the monthly period already paid.

Priority access to Yoojo customer support
Access to recurring service solutions available on the Platform
No service fees on bookings
No upfront payment required at the time of booking
Usage Limits: Where more than four (4) different Service Providers are booked within the same calendar month, the Platform's standard terms will automatically apply to any further bookings, namely:
Full payment for the service at the time of booking
A service fee of 20% of the Service Provider's remuneration or of the flat-rate charges described in section 4.2
Terms and Conditions:
Yoojo+ benefits apply exclusively to bookings made through the Yoojo Platform for personal and normal use of the Platform. They are non-transferable and non-refundable, even where the subscription is partially or wholly unused during a given period.
Yoojo reserves the right to suspend Yoojo+ subscription benefits in the event of a failed payment, payment default, or chargeback.
To ensure fairness among users and the sustainability of the service, Yoojo reserves the right to monitor subscription usage and take appropriate action in cases of misuse or fraud. The following are considered misuse, without limitation:
Creating or using multiple user accounts to circumvent subscription limits
Sharing an account with third parties
Any attempt to circumvent the monthly Service Provider booking limit
Using the Platform in a manner clearly inconsistent with its intended purpose
Any fraudulent activity or attempt to manipulate the Platform's billing mechanisms
Where there is reasonable suspicion of such conduct, Yoojo reserves the right, at its sole discretion and following a review of the case, to:
Temporarily suspend the benefits associated with the Yoojo+ subscription
Reinstate standard pricing conditions for the relevant bookings
Suspend or terminate the subscription
Changes to the Yoojo+ subsciption plan: Yoojo reserves the right to modify at any time the features, benefits, pricing, or terms of the Yoojo+ subscription. Customers will be given prior notice of any material changes through appropriate means (email, in-platform notification, or otherwise). Updated terms will take effect from the next renewal of the subscription. Customers who do not wish to accept the new terms may cancel their subscription before the renewal date.
4.4 Payment Terms
4.5 Proof of payment
Proof of the financial transaction results from the data recorded by the online payment organisation selected by Yoojo. Members are invited to keep the electronic ticket recorded in their account for their personal use.
Invoicing of service charges, transactions between members and certificates will be produced digitally; there will be no paper documents. All these elements, depending on the user's activity, will be accessible on the Platform.
Transaction receipts summarise the service requested by the Customer, the Service Provider concerned and the agreed pricing.
5. Yoojo Cover
Yoojo makes every effort to ensure that the Customer's request for services is fulfilled in the best possible conditions.
5.1 Basic Yoojo Cover
Yoojo cannot be held liable for any damages incurred during the Services. Depending on the circumstances, it is the responsibility of the Client or the Service Provider to activate their appropriate insurance.
However, to support its members and facilitate dispute resolution, Yoojo may offer to compensate Clients up to 250 GBP for damages caused by the Service Provider in connection with a service request that was booked and paid for on the Platform.
If a task is poorly executed, Yoojo may, at its sole discretion and after reviewing the file, propose one of the following solutions:
Redo the task: Yoojo may ask the initial Service Provider or another provider to perform the service again, as far as possible and subject to availability.
Damage contribution: If the task cannot be redone, Yoojo may offer a limited financial contribution towards any damages, up to an amount defined by Yoojo.
5.2 Yoojo Cover Plus
The Client can subscribe to a Plus support package. The price for this service will be calculated and clearly identified at the time of booking based on the service criteria.
The Plus option allows the client to benefit from priority customer support and increases the reimbursement cap to 1500 GBP instead of 250 GBP.
5.3 Conditions for Obtaining Compensation
To be eligible for compensation, the Client must prove that the Service Provider is responsible for the damages during the execution of the task booked on the platform, and provide the necessary evidence to assess the cost of the damages – for example, a purchase invoice or a quote.
Any claim must be reported within 7 days after the service and be accompanied by evidence (photos, detailed description, communications with the Service Provider).
5.4 Exclusion
Theft, loss or disappearance of goods entrusted to Yoojo cannot be addressed by Yoojo. Legal proceedings will have to be initiated with the competent authorities.
6. Cancellation policy
The Customer and the Provider may cancel the booking at any time prior to completion without incurring any financial obligation to each other.
The Platform's service fees are non-refundable. If the Customer cancels a service, the service fees remain payable except in cases of force majeure (serious illness, death).
In the event of cancellation by the Service Provider, the customer may book a new Service Provider for the same assignment at no additional cost, up to a maximum difference of 20%. If the assignment has to be cancelled definitively, the customer's "wallet" will be credited with an amount equivalent to the service fee for a future booking.
7. Complaints and Dispute Resolution Process
At the time of booking, the remuneration agreed between the Parties is held in escrow in the Customer's wallet for as long as the Customer does not confirm payment to the Service Provider.
Yoojo encourages the amicable resolution of disputes between customers and service providers. If an agreement cannot be reached, users can appeal to Yoojo's internal complaints department by submitting a request via our complaints portal.
8. Services and financial conditions for Service Providers
Yoojo provides Service Providers with a dedicated mobile application "Yoojo Jobber" to manage their profile, set up and automate their offers, synchronise their diaries, automate their Wallet and improve their visibility score.
No subscription or prepayment is required to access and use the application.
In return, the platform charges a commission of 7% of the revenue received directly via the platform. The commission is deducted from the Wallet when the Customer validates the payment.
Service Providers can subscribe to the "immediate" transfer option to instantly transfer the Wallet balance to their IBAN. This service is charged 1£ including tax.
9. Exclusion or withdrawal of a Member
9.1 Violation of the General Conditions
Any breach of these Terms and Conditions by a Member may lead to exclusion from the Site.
9.2 Other reasons for exclusion
Generally speaking, Members undertake to refrain from using the Site for any purpose:
offensive, defamatory, contrary to public order or morality;
infringing the privacy of third parties;
of a directly advertising or promotional nature or constituting advertising prohibited under the applicable legislation;
constituting the sending of unsolicited commercial messages;
designed to circumvent the social and tax rules applicable to job applications or offers;
incompatible with the protection of personal data;
constitutes denigration of a company or its products, parasitism, unfair competition or counterfeiting;
impairing the operation of the Site;
and, more generally, in breach of any law or regulation in force.
9.3 Consequences of exclusion
In the event of exclusion of a Member, no liability on the part of Yoojo may be incurred and all its job advertisements and/or service provider profiles shall be deleted.
9.4 Deletion of an account by a Member
Any Member may close his or her account at any time, subject to compliance with the obligations imposed on him or her prior to such closure (completion of a service, payment of publication fees, transaction between a Customer and a Service Provider, etc.).
If your account is deleted, a message will alert you to any transactions that may still be in progress. Users will have one month after deletion of their account to request reimbursement of their Kitty. After this period, the Wallet will be considered abandoned.
A deleted account cannot be recovered.
9.5 Inactivity
If the member is inactive for 365 consecutive days, the account will be considered abandoned and will consequently be deactivated.
At the end of this period of inactivity, the account will be considered abandoned and therefore deleted in accordance with the same rules defined in the previous paragraph. However, the Customer may recover the balance of the Wallet by sending a simple request by email to contact@yoojo.com, within 12 months of the account being deleted.
10. Provider Background Check Clause
10.1 Background checks on service providers
In order to ensure security and trust within the Yoojo community, each Provider may be subject to a background check procedure before registering on the Platform or during its use. This procedure, within the limits of applicable local laws, may include the following elements:
Identity verification: Yoojo reserves the right to confirm the identity of the Provider using official identity documents provided by the Provider.
Criminal record check: To the extent permitted by law, Yoojo may use specialised third-party services to check that the Provider has no relevant criminal convictions that could compromise the security of Users.
Professional qualifications and licences: Providers are required to provide the necessary licences, permits or certifications for the services offered via Yoojo, in accordance with local laws. Yoojo does not systematically check these documents but may request their presentation as part of the background check.
10.2 Consent of the Service Provider
By registering on Yoojo, the Provider consents to this background check and agrees that its data may be transmitted to Yoojo's verification partners solely for the purpose of conducting this check. Information collected as part of this process will be treated in accordance with Yoojo's Privacy Policy.
10.3 Limitation of liability
Yoojo endeavours to provide a secure environment by carrying out checks, but does not guarantee the accuracy, completeness or timeliness of information obtained as part of the background check. Yoojo accepts no responsibility for any misrepresentation or errors in the information provided by the provider or third party services.
11. Protection of Personal Data
In accordance with data protection laws, Yoojo is committed to protecting users' personal data. This data is collected and processed solely for the purpose of using the platform.
Data management: Yoojo does not share any personal data with third parties without the explicit consent of users.
Right of access and rectification: In accordance with the law, users may access, modify or request the deletion of their personal data by contacting Yoojo at contact@yoojo.com.

12. Intellectual property
12.1 Yoojo intellectual property
Yoojo holds the intellectual property rights to the Site considered as a support for the advertisements published by the Members (architecture of the Site, organisation of functionalities, ergonomics, software functionalities, etc.). Any reproduction of the elements constituting the Site without the prior written authorisation of Yoojo is likely to constitute an infringement and may incur the civil and/or criminal liability of its author.
12.2 Use of external Intellectual Property on the Site
Members undertake not to publish on the Site any element (text, photograph, image, logo or any other creation or sign subject to intellectual property rights) without the prior written consent of the holder of the rights.
Where necessary, Members grant Yoojo a licence to use the intellectual property rights attached to the content that they may insert on the Site. This worldwide licence and for the duration of the rights in question includes in particular the right for Yoojo to reproduce, represent or adapt said content to enable its optimal presentation on the Site (in particular with regard to its graphic charter and technical performance).
12.3 Content Usage License by Yoojo
Members (Clients and Providers) acknowledge and agree that any photograph, image, or visual content they publish on the Yoojo Platform as part of a service listing or review may be used by Yoojo for promotional and communication purposes.
As such, Members grant Yoojo a worldwide, free, non-exclusive, and transferable license to reproduce, display, modify, adapt, and distribute this content across all communication media related to Yoojo, including but not limited to:
The Yoojo website and mobile applications,
Yoojo's social media channels (Facebook, Instagram, LinkedIn, Twitter, etc.),
Online and offline advertising campaigns,
Marketing and promotional materials (newsletters, posters, videos, etc.).
This license is granted for the entire duration of the intellectual property rights associated with the said content, unless an explicit removal request is made in writing by the Member to contact@yoojo.com. In such a case, Yoojo commits to removing the concerned content within a reasonable timeframe, subject to technical constraints and ongoing campaigns.
Members guarantee that they hold the necessary rights to the content they publish and agree to indemnify Yoojo against any third-party claims related to the use of this content.
This clause allows Yoojo to freely use photos from listings and reviews while giving users the option to request their removal if needed. It also ensures that Yoojo will not be held liable in case of disputes regarding image rights.
13. Waiver of Recourse
The Members of the Yoojo platform (Customers and Providers) expressly acknowledge that Yoojo acts solely as an intermediary to facilitate contact between users. By using the Platform, Members agree to irrevocably waive any recourse against Yoojo for:
Damages related to the provision of services: Members waive any right of recourse against Yoojo for claims, losses, costs, or damages of any kind arising directly or indirectly from the provision of services, including, but not limited to, property damage, personal injury, or financial loss caused by the service provider or occurring during the provision of services.
Consequential damages: Yoojo shall not be liable for any consequential loss, loss of profits, loss of data, business interruption, or additional costs incurred as a result of the use or inability to use the platform, including in connection with disputes or service interruptions.
Responsibility for the Contract between Members: As the client and the service provider are solely responsible for their respective commitments, no recourse may be exercised against Yoojo in the event of non-execution, imperfect execution, or any contractual dispute arising between the members of the platform.
Insurance and Coverage: In cases where warranty coverage (such as the Yoojo Cover program) is applied, the maximum compensation amounts are strictly limited to the amounts set forth in the dedicated section. No request for additional compensation may be addressed to Yoojo outside these limits.
This waiver of recourse applies to the maximum extent permitted by law. If a mandatory local law limits this waiver, it will only be applied to the extent permitted.
14. Applicable law and jurisdiction
These General Terms and Conditions are governed by the laws of Switzerland, to the exclusion of the rules or principles of conflict of laws on international private law. However, if you reside in a country other than Switzerland, these General Terms and Conditions may be subject to the mandatory consumer protection laws and regulations in force in the country of residence, which may confer additional rights on you. Any disagreement, claim or dispute arising from these Terms and Conditions or your membership must be resolved before the competent courts in Switzerland, unless otherwise stipulated by the mandatory consumer protection laws applicable in your country of residence.
The invalidity or inapplicability of certain contractual provisions shall not affect the validity of the other contractual provisions. In this case, the ineffective or inapplicable provision must be replaced by the parties by a new effective or applicable provision.
